This comes after being accused of false advertising for its pickle products. This resolution arises from a class action lawsuit that questioned the veracity of the labels of the pickles marketed by the company, and although the company does not accept the accusations, it decides to pay to avoid future legal costs, which in the United States can amount to hundreds of thousands of dollars, just in lawyers.

The controversy centers on the claims made by Wahlburgers pickles, which were advertised as “fresh,” “all-natural,” and “preservative-free.” However, the plaintiffs alleged that these qualifiers were not truthful, because these products contained sodium benzoate, an artificial preservative that, although safe for human consumption, contradicted the commercial claims under which they were sold. 

This contrast between the advertising and the actual content of the product is what triggered the legal process against the company, and it is then that the fast food chain decided to pay the plaintiffs.

Although Wahlburgers has strongly denied any wrongdoing or regulatory violations, the company decided to settle to avoid the costs and complications of protracted litigation. In this context, a Wahlburgers spokesperson said that the settlement is not an admission of guilt, but rather a pragmatic measure to focus on the business and customers.

How to Claim a Payment In the Wahlburgers Lawsuit Payment

Consumers who purchased Wahlburgers pickles between April 1, 2021 and March 31, 2023 may be eligible to receive cash compensation, and will not be required to provide proof of purchase for up to six products, which is equivalent to a maximum refund of 12 dollars. Those who can provide proof of purchase will be able to claim unlimited refunds for each product purchased.

To make the compensation effective, consumers must submit a valid claim form by July 29, 2024. Those interested in opting out or filing objections to the terms of the settlement have a deadline of September 4, 2024. Final approval of the agreement will be discussed at a hearing scheduled for September 25, 2024.
